Controller

Kingsway Group Global Limited and Kingsway Group, Inc. (US) are the controllers and responsible for your personal data (collectively referred to as Kingsway, “we”, “us” or “our” in this privacy policy). Kingsway Group Global Limited is made up of different legal entities and specifically Kingsway Group, Inc. (US) is a wholly owned subsidiary of Kingsway Group Global Limited. This privacy policy is issued on behalf of the Kingsway Group so when we mention Kingsway, “we”, “us” or “our” in this privacy policy, we are referring to the relevant company in the Kingsway Group responsible for processing your data Kingsway Group, Inc. (US) is the controller and responsible for this website. We have appointed a data privacy manager who is responsible for overseeing questions in relation to this privacy policy. The data we collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data includes first name, last name and company (usually employer.)
  • Contact Data includes billing address, delivery address, email address and telephone numbers.
  • Technical Data includes internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.
  • Profile Data includes your interests, preferences, feedback and personal communications with us.
  • Usage Data includes information about how you use our website and whether this results in enquiries or purchases of our products and services, either personally or on behalf of another business.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Unless you apply for a job role with us, we do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data).  Nor do we collect any information about criminal convictions and offences.

If you apply for a job role with us, we may also collect, store and use the following more sensitive types of personal information both during the recruitment process and during your employment: Special Category Data (for employees and applicants for job roles) about:

  • your race or ethnicity
  • trade union membership.
  • Information about your health, including any medical condition, health and sickness records, including:
    • where you leave employment and under any share plan operated by a group company the reason for leaving is determined to be ill-health, injury or disability, the records relating to that decision;
    • details of any absences (other than holidays) from work including time on statutory parental leave and sick leave;
    • any health information in relation to a claim made under the permanent health insurance scheme; and
    • where you leave employment and the reason for leaving is related to your health, information about that condition needed for pensions and permanent health insurance purposes.

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you.   • Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets.

Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy. We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

International transfers

We share your personal data within the Kingsway Group. Many of our external third parties are based outside the US so their processing of your personal data will involve a transfer of data outside the US. Whenever we transfer your personal data out of the US, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
